My neighbor is complaining about my tree droppings staining his cars.How do I find out my rights and his? ?
I spent 00 trimming this redwood last spring to keep him happy, but that is the nature of the tree. He parks his cars outside and when the weather is right, the tree drops little things that stain his car paint. He’s furious and I have no $ and don’t know what he wants me to do. I cannot find out what I have to do legally and I want to resolve this positively.

Tell him too bad. If it’s not on his property there isn’t a damn thing he can od about it. Tell him to park it somewhere else too….. where the sun don’t shine

yeah if the tree isn’t on his property he can’t do anything about it. so tell him to shutup. =) and don’t worry about it. Its on your property tell him to park else where.

If your tree overhangs his property, he does have a right to trim it, even all the way to your property line. Since you don’t have any more money left for tree trimming, explain this to him and allow him to decide whether he wants to hire someone to do the trimming.

Reasonable expectation dictates that if the tree was there when he moved in; whether it was 3 years ago or 30 years ago, it is reasonable to expect droppings from a tree.
Because he has air rights to his property, he can trim whatever is in his space ….at his expense.

What ever part of the tree that goes over the property line is his to trim. I wouldn’t worry about it. If he’s that concerned and worried about it, he can pay to have someone to trim the branches that overhangs his property line. Or he needs to park his car somewhere else! I know I would.
My neighbor has a really pretty shrub with thorns, like a black berry bush or something like that. It was growing through my fence and hanging over the top of it. I pushed some back through the fence, but some I just cut it even with the fence because my driveway runs along beside the fence line and I had to drive off the driveway to keep from scratching my car! I didn’t even say anything to them about it, because I knew they didn’t care if I trimmed it on my side of the fence! I know that part belongs to me!
I’m sorry you are worried about it, but I wouldn’t worry about it. Trees are worth a lot of money. And it’s not your place to deal with what overhangs his property. And if it’s just the wind doing it, then that is part of nature and not you!

There should be a mediation process through the court in your city or county. Call the courthouse and see what they can tell you. A mediator is supposed to listen to both sides of the story and help arrange an agreement between the two parties. I feel for you, it seems the guy would get smart and park somewhere else when the tree drops stuff. That’s what the rest of the world usually does.
